Hotel Terms & Conditions

These booking terms apply to Ernespie Housel Hotel, our officers, employees and agents (‘We’/’Us’/’Our’) and the person or legal entity making the booking or to whom we supply services in respect of the booking (‘You/Your’). These booking terms are governed by Scottish Law and apply to all bookings except where we agree in writing other terms. By making a booking you are deemed to accept these booking terms. Please note bookings made on different web sites may be booked with different conditions.


Bookings

Bookings are made and a contract between you and us comes into effect when we accept a reservation from you. We will accept a reservation when we have confirmed your reservation and charged/received a non-refundable deposit payment. The balance will be paid by you to us upon departure.

You must be able to enter into a legally binding contract and be over 18yrs to make a booking (Bookings may be accepted on behalf of teenagers in certain circumstances).

Bookings must be paid for using an acceptable and valid credit or debit card. Please contact us for alternative means of payment.


Credit Cards

All credit card transaction must be made by the cardholder or with the cardholders permission (in the latter case an email, fax or letter from the card holder authorising the transaction is required).


Access to Information

The EU GDPR (2016/679/EU) gives you the right to access information held about you. Your right of access can be exercised in accordance with the Regulation. Any access request should be sent to enquiries@ernespiehousehotel.co.uk along with proof of identity. If you are not satisfied with a request to access your information you have the right to lodge a complaint with the Information Commissioners Office (ICO) by using the following URL - https://ico.org.uk/concerns/handling/


Cancellations

Cancellations must be made 24 hours prior to your arrival. To make a cancellation you must call us and give your name and check-in date and have details of your credit or debit card available. All deposits are non refundable..


Prices

Rates are per room per night and include Breakfast, Service and VAT (tax) at the current rate.

If you have selected supplements they will be added to the total price of the booking. Rates do not include other costs you may choose to incur during your stay (unless otherwise stated).

Rates quoted are correct only for the specific number of guests, nights, room type and dates shown. Should you change the number of guests, dates, room type or room nights, then the rates are subject to change. All rates are subject to change.


Arrival and Departure

Check-in time after 15.00pm. A request for an early check-in time can be requested directly with us but this cannot under any circumstances be guaranteed. Check-out time: 11.00am. We can keep reasonable amounts of luggage for you before check in and after check out.


Amendments

To amend or cancel Your booking, call us directly.


Payment

We will charge a non refundable deposit payment (per night). The balance will be paid by you to us upon departure. All additional goods and services purchased during your stay must be paid in full on check-out.


Conditions of stay

We operate standard rules that are designed to ensure that we comply with regulations relating to matters such as fire, health and safety, and to enhance the comfort and wellbeing of our guests.

We reserve the right to terminate your booking immediately without being liable for any refund or compensation where you engage in unacceptable behaviour that causes a disturbance or nuisance to other guests.


Children

We welcome children of all ages.


Non Smoking Premises

Ernespie House Hotel is a non-smoking building. It is against the law to smoke in the premises and offenders could be reported to the relevant authority. If a member of staff has reported to the Management that they suspect a guest has been smoking in the guest rooms or there is evidence of smoking in the guest rooms, we reserve the right to charge a fee of £75.00 so that the room may be deep cleaned and aired before the next guest and in some cases the room will need to be taken out of service.


Damages and Breakages

Please take care when staying in our property. You are responsible and liable for any breakages or damages, which you cause, to the accommodation or its contents.


Liability

Other than for death or personal injury caused by our negligence or misrepresentation, our total liability to you is limited to the price of the booking and to the fullest extent permitted by law all warranties are excluded and in no circumstances will we be responsible for any indirect or special damages.

We will not be liable for failure to perform to the extent that the failure is caused by any factor beyond our reasonable control. You are responsible for any damage or loss caused to us or our property by your act, omission, default or neglect and you agree to indemnify us and to pay us on demand the amount reasonably required to make good or remedy any such damage or loss.

The management reserves the right to change these terms or rates at short notice.
